Terms and conditions

1. Definitions

Customer/consumer: The natural person who is not acting in the exercise of a profession or business and enters into an agreement with the entrepreneur.

Entrepreneur: The legal or natural person who offers products and/or services through the webshop https://lambello.com. 

Distance contract: An agreement whereby, within the framework of a system organized by the entrepreneur for distance selling of products and/or services, use is made of one or more techniques for distance communication.

Reflection period: The period within which the consumer can exercise his right of withdrawal.

Right of withdrawal: The possibility for the consumer to waive the distance contract within the withdrawal period.

Day: Calendar day.

Duration transaction: A distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.

Durable data carrier: Any means by which the consumer or entrepreneur can store information addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored information.

3. Applicability

These general terms and conditions apply to every offer of the entrepreneur and to every distance contract concluded between entrepreneur and consumer.

Before the agreement is concluded, the text of these general terms and conditions will be made available to the consumer.

If the agreement is concluded electronically, the text of these general terms and conditions may be made available to the consumer electronically.

Situations that are not regulated in these general terms and conditions will be assessed “in the spirit” of these general terms and conditions.

 

4. The offer

If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated.

The offer contains a complete and accurate description of the products and/or services on offer.

Obvious mistakes or errors in the offer do not bind the entrepreneur.

All images and specifications in the offer are indicative and cannot give rise to compensation or dissolution of the agreement.

 

5. The agreement

The agreement is concluded at the moment the consumer accepts the offer and fulfills the set conditions.

If the consumer has accepted the offer electronically, the entrepreneur immediately confirms receipt of the acceptance electronically.

The entrepreneur takes appropriate technical and organizational measures to protect the electronic transfer of data and ensures a secure web environment.


6. Right of withdrawal

The consumer has the right, within 30 days of receiving the order, to revoke the agreement without giving reasons.

During the withdrawal period, the consumer must handle the product and packaging with care. If he exercises his right of withdrawal, he must return the product in its original condition and packaging.

The costs of return shipment are to be borne by the consumer, unless otherwise stated.

Exceptions to the right of withdrawal:

Products that are custom made or personalized.
Hygiene products whose seal has been broken.


7. Prices and payment

All prices on the website are in Australian Dollars and include VAT, unless otherwise stated.

Any import duties and customs fees are to be paid by the consumer.

The consumer has the duty to immediately report inaccuracies in payment details provided or mentioned to the entrepreneur.

8. Delivery and execution.

The entrepreneur will take the utmost care when receiving and executing orders for products.

The delivery time is 2-4 working days after processing the order.

If delivery is delayed, the consumer will be informed as soon as possible.

 

9. Warranty and conformity

The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications mentioned in the offer and legal requirements.

If the product does not comply with the agreement, the consumer should report this within 7 days after discovery.

Warranty expires if:

The consumer has repaired the product himself or had it repaired.
There is improper use.

 

10. Complaints procedure

Complaints about the implementation of the agreement must be submitted to the entrepreneur within 7 days after observation, fully and clearly described.

The entrepreneur strives to provide a substantive response within 14 days after receipt of the complaint.

If a complaint cannot be resolved by mutual agreement, a dispute arises which is subject to the laws of Australia.

 

11. Liability

The entrepreneur is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the website and products offered.

The entrepreneur is not responsible for delays caused by third parties, such as courier services.

In case of force majeure, the entrepreneur has the right to suspend delivery or cancel the agreement without being liable for damages.

 

12. Applicable law

All agreements and disputes between consumer and entrepreneur are governed by the law of Australia.

Disputes can be submitted to a competent court in Australia.
